Impaxio Privacy Policy

This privacy policy is authored by Impaxio GmbH, Seestr. 436, 8038 Zürich, Switzerland (hereinafter, “Provider”). This privacy policy explains how the Provider uses the personal data that the Provider collects from users of its services (hereinafter, “Customers”). This includes website visitors, customers of the Provider’s services and their employees, and survey respondents.

1. Collection of personal data

The Provider collects data and processes data when customers visit the Provider’s websites. The web server automatically records general technical data about Customer’s visits. This encompasses various details such as the IP address of the device being utilized, type of browser being used, the internet service utilized, and the operating system in use.

When Customers access the login area of the website, any information provided by the Customer during registration and while using the Provider’s products and services will be stored.

Customers personal data is also collected during activities such as registration, placing orders, completing online forms, taking surveys, entering contests, communicating with the Provider through online or offline channels, or engaging with the Provider through social media, blogs or other interactive platforms.

The Provider may also receive Customer’s data indirectly from partner companies.

2. Purpose of personal data processing

The Provider utilizes the collected personal data to enhance its products and services continuously. Additionally, the data is used to manage access to the applications, products, and information, conduct surveys, sustain business relationships, monitor and enhance the performance of its offers, identify, prevent or clarify illegal activities, and forward marketing materials and offers about products or services, based on the data. The collected data may also be disclosed to partner companies, service providers, third-party companies, and legally authorized government authorities for the above-mentioned purposes.

3. Data storage and security

The Provider securely stores Customer’s data on servers located in Switzerland and in the European Union. SSL encryption is utilized to establish a secure connection to these servers. Some services may be processed through servers located in other countries, provided that they offer an adequate level of data protection.

The security measures are constantly adjusted and enhanced to keep up with technological advancements. The Provider is not responsible for any data loss, unauthorized access, or usage of data by third parties. Additionally, the Provider cannot ensure the security of data transmission over the internet.

The Customer's personal data remains stored for the duration of their use of the Provider's services. Once the use of these services is terminated, the Provider is no longer obligated to retain Customer’s personal data. The data is typically deleted, unless legal regulations dictate its continued storage.

4. Marketing and E-Mail Newsletter

If the Customer wishes to receive information about the Provider’s products and services, as well as those of partner companies, the Provider requires consent by the Customer to receive marketing information and, for newsletters, a valid e-mail address of the Customer. Customers have the right at any time to stop the Provider from contacting them for marketing purposes. Customers who no longer wish to be contacted for marketing purposes, can withdraw their consent at any time by sending an e-mail to info@impaxio.com or via the “unsubscribe” link in the newsletter.

5. Data protection rights

Customers are entitled to specific rights concerning their personal data under the Swiss Federal Act on Data Protection ("FADP") or the EU General Data Protection Regulation ("GDPR"). The Provider generally recognizes these rights for all Customers, including those from other countries. Nevertheless, the Provider retains the discretion to evaluate each case individually and make a different determination.

• The right to access – Customers have the right to request copies of their personal data. The Provider may charge the Customer a small fee for this service.

• The right to rectification – Customers have the right to request that the Provider corrects any information the Customer believes is inaccurate. Customers also have the right to request the Provider to complete the information the Customer believes is incomplete.

• The right to erasure – Customers have the right to request that the Provider erases the Customer’s personal data, under certain conditions.

• The right to restrict processing – Customers have the right to request that the Provider restricts the processing of the Customer’s personal data, under certain conditions.

• The right to object to processing – Customers have the right to object to the Provider’s processing of the Customer’s personal data, under certain conditions.

• The right to data portability – Customers have the right to request that the Provider transfers the data that the Provider has collected to another organization, or directly to the Customer, under certain conditions.

If the Customers makes a request, the Provider has one month to respond to the Customer. If the Customer would like to exercise any of these rights, the Customer is advised to contact the Provider in writing to the Provider’s address or via e-mail info@impaxio.com. Thereafter, some of the Provider’s services may no longer be available for the Customer.

6. Cookies

Cookies are text files placed on computers to collect standard Internet log information and visitor behavior information. When Customers visit the Provider’s websites, the Provider collects information from Customers automatically through cookies or similar technology. The Provider uses cookies in a range of ways to improve users experience on the Provider’s website, including keeping Customers signed in and understanding how the website is used.

There are a number of different types of cookies, however, the Provider’s website uses:

• Functionality – The Provider uses these cookies so that it recognizes Customers on the website and remember Customer’s previously selected preferences. These could include what language Customer’s prefer and location Customers are in. A mix of first-party and third-party cookies are used.

• Advertising – The Provider uses cookies to collect information about Customers visits to our website, the content Customers viewed, the links Customers followed and information about Customer’s browser, device, and IP address. The Provider sometimes shares this data with third parties for advertising purposes. The Provider may also share online data collected through cookies with advertising partners. The Provider’s website contains links to other websites. The Provider’s privacy policy applies only to the Provider’s website, so if Customers click on a link to another website, Customers should read their privacy policy.

8. Changes to the Provider’s privacy policy

The Provider keeps its privacy policy under regular review and places any updates on this web page. This privacy policy was last updated on 3 March 2023.

10. Right to lodge a complaint

Customers have the right to file a complaint with a competent supervisory authority under Article 77 GDPR if they believe that the processing of their personal data violates GDPR.
